　　山西怀仁：老海请赵小超回复

　　怀仁市人民法院、赵小超院长：

　　诉求：请贵单位尊重最高法的要求，将非法挂牌“大同市第三人民医院怀仁分院”的怀仁仁德医院和大同市第三人民医院的“非法挂牌案”出具最高法需要的具体信息（最高法信息内容截图后附）。

　　事实与理由：

　　事实：1、山西省朔州市怀仁市仁德医院非法悬挂“大同市第三人民医院怀仁分院”系非法行为。此事，引发官司。对此，怀仁市人民法院不该受理却进行了受理。之所以不该受理，因为：双方虽有所谓的合作合同，但，该合同并无合法基础。原因：根据党的领导制定的政策，公立医院异地设立分院时，必须经过公立医院所在市级、省级主管部门的审批通过方可。而大同市第三人民医院在异地设立分院未经审批通过，并且，诉讼当时，仁德医院已经没有一个大同市第三人民医院的工作人员。对此毫无合法基础的所谓“合作合同”，当地法院居然受理并作出“仁德医院胜诉”的不法判决。实际上，当时及当下，且不说仁德医院存在大量其他问题，仅就“非法挂牌”一项，仁德医院纯粹是挂羊头卖狗肉，用公立“大同市第三人民医院”的牌子欺骗当地群众。2、针对上述内容，本人曾经于2024年1月8日直接致信贵单位。截止今天，已经96天过去了。贵单位和赵小超院长从未作出任何回应。此举，怀仁法院已经违反了《信访工作条例》和《宪法》精神。3、以上事实证明，怀仁法院不但对“大同三医院怀仁分院非法挂牌”一案存在问题，并且，知法犯法，公然对抗党中央制订的《信访工作条例》和我国《宪法》。怀仁法院不但存在对抗我国法律的实际表现，而且悍然展示了他们的“官僚主义”和“蔑视群众监督”的工作作风。4、上述事实，当地法院涉嫌“胡乱受理、胡乱判决”，主审法官毫无政治忠诚，明显架空党的领导，明显脱离党的指导思想，视法纪规则为游戏规则，践踏了“中国特色社会主义法治精神”，践踏了“全心全意为人民服务”的宗旨。
