黑龙江省牡丹江市：存疑的原告 存疑的证据 打赢了一场诉讼

　　近日，随着再审申请的不予受理，已过花甲之年的胡某群在这场疑点重重的诉讼中彻底败诉了。并非车辆所有人，向法院提供了存疑的证据居然堂而皇之地胜诉了。

　　2006年，刘某彬要卖给胡某群一台吊车签订了一份《吊车购买协议》，由于刘某彬当时有公职身份，所以协议是以刘某彬父亲刘某生名义签订的，协议上的签名是刘某彬代替其父亲签的名字，实际履行协议的也是刘某彬。交易价格100万元，约定2006年10月份先付现金50万元，2007年3月份付余款50万元。

　　履行完协议十余年后，在2019年4月，胡某群竟然接到了刘某彬的电话，刘某彬让胡某群回忆下剩下的50万吊车款是怎么支付的，之后再无他话。谁知，2020年8月25日，刘某彬以其父的名义将胡某群告上了法庭，主张索要吊车款及产生的利息。

　　“要知道，自2006年11月以后，到2019年4月那通电话，之间10余年我们没有过任何联系，如果我们没有支付吊车款，为何这10余年刘某彬没有索要过？这样是否过了诉讼时效？”胡某群说。

　　据胡某群代理律师介绍，根据《民法典》第一百八十八条规定，向人民法院请求保护民事权利的诉讼时效期间为三年。法律另有规定的，依照其规定。很明显过了诉讼时效的问题，黑龙江省牡丹江市东安区人民法院还是受理了此案，受理理由是诉讼时效中止，而根据民法典的规定，本案不涉及诉讼时效中止的情形。

　　在此情况下，该院判决胡某群在十日内给付刘某生吊车款100万元及利息。之后，胡某群向牡丹江中级人民法院提起了上诉，2021年6月15日该院驳回了胡某群的上诉，维持原判。2022年2月25日，申请人向黑龙江省高级人民法院又提起了再审申请，后驳回了胡某群的再审申请。

　　据胡某群介绍他曾经咨询过车管所，一位工作人员介绍该车辆在2012年12月10日已被灭失，灭失的车辆是不能查到档案的。但在2020年9月17日，刘某生代理向法院提交了调取车辆信息的申请，之后，也拿到了车辆信息。

　　而之后，胡某群在去调取车辆信息事，仍被告知灭失的车辆两年后就不能调取车辆档案了，那庭审中出示的车辆档案是怎么调出来的呢？

　　此外，胡某群还发现原告提交的车辆档案上车管所的落款章与他提供材料里的落款章不一样，刘某彬提供的车辆材料公章上有黑龙江省字样而胡某群在车管所查询时的公章没有这几个字。

　　而且观看裁剪后的骑缝章，在拼接后明显少了几个字？那是不是少了几页纸张呢？

　　另外，原告本身也很值得商榷。从交易直到车辆被灭失，车辆所有人一直是张某庆。并未发过登记变动，也就是说胡某群并未成为过车辆所有人，刘某彬和其父亲也不是车辆所有人他们没有权利买卖该车辆。
